The San Luis Obispo Planning Commission voted unanimously on Wednesday to revoke the conditional use permits for Delta Chi and Sigma Nu fraternities, which allows them to operate their official chapter houses in the city.
The fraternities will still be allowed to gather at their houses until the next public meeting on June 11, when the commission will review and finalize the resolution proposal, Community Development Director Tyler Corey said at the meeting. While the vote is final, the formal resolution will be confirmed on June 11.
The permit revocations were issued “without prejudice,” meaning both fraternities can reapply for permits at any time, Corey explained.
The city has faced ongoing conflicts between fraternities and residential neighborhoods, and officials felt that change was necessary during the re-review process, said Planning Commission Chair David Houghton. Revoking permits is rare, but there was precedent for it, he said.
”We felt like we needed to do something to precipitate a larger discussion that attempts to really solve this problem, or at least make it a lot better,” Houghton told Mustang News.
Repeated residential complaints and numerous city citations for noise, unruly gatherings and safety enhancement zone violations triggered the commission’s re-review of permits, Assistant Planner Mallory Patino said at the meeting. Delta Chi also violated permit code for converting balconies into enclosed bedrooms.
Located at 1304 Foothill Blvd., Sigma Nu has received three noise violations and one unruly gathering violation. Delta Chi, at 1236 Monte Vista Plaza, has seen two noise violations — one of which was successfully appealed — and one unruly gathering.
Delta Chi President Jakob Zuckermandel maintained that his fraternity takes safety and crowd control “extremely seriously,” and apologized for past issues in the meeting.
“We are not asking for leniency. We are asking for a fair chance to continue operating from a registered chapter house, a chance to constructively work with the city,” Zuckermandel said in his meeting statement. “A gathering restriction may unintentionally limit our ability to follow the very rules we are striving to uphold.”
Sigma Nu President Charlie Minor highlighted the changing culture of his fraternity’s gatherings, citing the move of general meetings to campus and communications with the city and the police department.
“When mistakes occur, we accept responsibility and the consequences that follow,” Minor said. “We are also committed to learning, improving and honoring the expectations set by the commission as well as the City of San Luis Obispo.”
Minor also emphasized the fraternity’s efforts to prevent unscheduled crowds and noise often caused by nearby nightlife, by installing portable chain-link fences around the property each weekend.
