The pre-preliminary hearing for former Cal Poly RA Alexis Alejandro, accused of breaking into PCV with the intent to commit rape, has been postponed to Oct. 28.

The decision came on Monday morning after Alejandro’s defense set a motion to vacate the preliminary hearing of the case.

The pre-preliminary is scheduled for the prosecution and defense to continue to negotiate possible deals.

Alejandro appeared in court this morning for a bail reduction hearing, which was also vacated till Oct. 28.

In vacating his trial, Alejandro waives the right to a speedy trial. Alejandro, 25, is charged in violation of penal code 220 (B) – intent to commit rape during a commission of residential burglary in connection to the Sept. 7 PCV breakin.
