Update: As of Nov. 13, Abate’s attorney has filed an appeal for a new trial. Judge Michael Frye acknowledged that the appeal is based on serious grounds that cannot be ignored. Further updates on the case will be provided as information becomes available.

Jurors delivered a partial verdict late Friday afternoon in the sex crimes trial of Nathan Abate, finding him guilty on three of four charges, including rape by force or fear, rape of an intoxicated person, and oral copulation of a minor. 

Abate, the owner of Atascadero Cardinal Barbershop, has charges stemming from three victims dating back between 2008 and 2012, according to court documents.

The jury remained deadlocked on the first count of rape by force or fear, prompting Judge Michael Frye to declare a mistrial for the separate charge after 16 hours of deliberation.

After the 13-day trial, the jury found five factors true prompting Abate’s conviction: 

  • The victims were particularly vulnerable. 
  • Abate induced a minor to participate in a crime. 
  • The crimes were carried out with planning, sophistication, and professionalism.  
  • Abate violated a position of trust when committing his crimes. 
  • Abate engaged in violent conduct that posed a serious danger to society.

Following the verdicts, Abate will remain in custody in the San Luis Obispo County Jail, according to Frye. Sentencing is scheduled for Nov. 12.
